1. Scope and Applicability

These General Terms and Conditions of Sale ("Terms") apply to all sales of vehicles by Universal Truck Exports BV/SRL ("UTE") to any buyer, whether individual or legal entity ("Client"). Any deviations from these Terms must be expressly agreed in writing.


2. Orders and Confirmation

Orders are placed through a written order form confirmed by the Client. UTE reserves the right to accept or refuse any order. A sale is considered final only upon written confirmation by UTE and receipt of the initial payment.


3. Prices and Payment Terms

  • All prices are provided in writing and exclude VAT unless otherwise stated.
  • A minimum 30% deposit is required upon order confirmation;
    this percentage may vary depending on the arrangements and communication made with the client during the order process.
  • The remaining balance must be paid in full prior to delivery of the vehicle(s).
  • All payments must be made via bank transfer through a recognized financial institution.
  • Invoices are subject to VAT, depending on the applicable regime and country of destination.


3b. Purchasing Delay and Vehicle Collection
Upon execution of the sales agreement, the customer is required to remit full payment within fourteen (14) days.
The customer shall collect the vehicle within twenty-eight (28) days from the date of the sales agreement, unless otherwise expressly agreed in writing by Universal Truck Exports.
Should the customer fail to collect the vehicle within the specified period, UTE shall be entitled to charge a storage fee of ten euros (€10) per day for each day the vehicle remains on UTE’s premises.

4. No Cancellation – Non-Refundable Deposit

Once confirmed, orders cannot be cancelled by the Client.

Deposits are strictly non-refundable, regardless of the reason.


5. Delivery and Risk Transfer

  • Delivery time is typically estimated between 3 to 4 weeks, subject to vehicle availability and logistics.
  • Transport can be organized by either UTE or the Client, by prior agreement.
  • No Incoterm is contractually applicable unless explicitly agreed in writing.
  • Risk is transferred to the Client upon handover to the carrier.
  • Ownership remains with UTE until full payment of the vehicle(s) has been received.


6. Transportation & Shipping


If we arrange transportation on behalf of the customer, the shipment is handled by an independent third-party freight company. Our responsibility ends once the truck has been handed over to the shipping supplier. We cannot be held liable for any delays, damages, or incidents occurring during transportation. Shipping costs are based on the current pricing applied by freight companies and may fluctuate depending on the period, fuel costs, and market demand.


If the customer chooses to arrange their own transportation, we are not responsible for any logistical arrangements. It is the customer’s carrier’s responsibility to pick up the truck from our site. We do not provide assistance for loading operations, nor do we supply any loading equipment or materials.


For self-arranged international shipments (export), the buyer must provide all necessary export documents for our administrative records. In such cases, VAT may be charged at the time of invoicing and can be refunded once the complete and valid export documentation has been received and verified by us.


6. Warranty and Liability

Vehicles are sold without any warranty, either express or implied.

UTE declines all responsibility for any mechanical, technical, or regulatory issues arising after delivery, regardless of destination country.


7. Retention of Title

Until full payment of the agreed sale price, UTE retains legal ownership of the vehicle(s). The Client is not entitled to resell, pledge, or assign the vehicle(s) before full payment has been made.


8. Applicable Law and Jurisdiction

These Terms are governed by Belgian law.

Any disputes arising from the commercial relationship will be submitted to the courts of Belgium, without prejudice to UTE’s right to bring action in the Client's jurisdiction if deemed necessary.


9. Data Protection

UTE collects personal data (such as names, contact details) strictly for the purpose of commercial transactions and invoicing. A separate privacy policy is available upon request.
